Squeapler,
I agree wholeheartedly on the take for state’s rights. Need to look at your post some more for the civilrights justification and think on it. my own reasoning would stem from the new federalism with block grants etc. that finacially and legally allow state;s to do what they want with fed money vs. them being held to dictates. Now, we know those grants are set up to have states carry out fed directives to an extent, but the wordings of these directives are such that the states have much more latitude than in the days of layer-cake federalism.
How does federalism impact the RIAA ties? Not sure, since entertainment is still an open and free market with no federal manufacturing of music (thank god). With as many different political angles to pursue, I still could see a wide open approach to this matter if our judicial branch would to get involved. Perhaps the party influence might come out in amicus curae briefs by lobbyists but we have too many cross-geographical influences and financial interests to say it could go one way or the other. However, I am really learning a lot with the way it is unfolding and from having the chance to discuss it with you all right here. Thanks.
Tom
I have kept quiet for a few days and frankly am suprised at the feedback. See, porn must be good for you!
Let me tell you why I tied that into this issue since no one has either mentioned it or figured it out:
Squeapler and RBB probably know this but in 1996 Congress passed the Communication Decency Act, prohibiting transmission of "obsence" materials etc. Many civil rights groups felt encumbered and got the ACLU to file a suit that reached the S/C called Reno vs. ACLU. Here, the CDA was overturned. The most obnoxious use of privacy was upheld. If you all want to look at this as a matter of partisanship, feel free. But this is issue oriented before party hacking.
You also probably know that the RIAA almost had riders attached to the Patriot anti-terrorism bill, before opposing lobbysits, such as the EFF, got the kabosh on that travesty and heinous use of misfortune for political influence.
My last point on why I think this whole swapping thing will come full circle in the House of Columns is that all interstate commerce is federally controlled. This is no big news, but any appeals will rocket this thing right up the line with all the potential ties to either established cases or to aspects of these cases that have not been explored for the sake of the needed precedent.

P.S. Allison and Malc I will check out your links soon.
P.P.S. If you take a peek through Open Topics from about a year ago until now, you will find several threads that tie neatly into this one. I will post them if I find time to look.

Carl.
There has been some talk on organizing a grass roots collective. I died off on my end of it due to time restrictions and not enough support. I have been trying to keep up with a very powerful political action committee you are probably familiar with, the Electronic Frontier Foundation .Things have been pretty quiet lately since a bill to lock anti-copying devices into most media hardware died in committee on Capitol Hill. EFF has more on this and so do a few other FS members who pulled my coat to it. If you want to chat more my AIM is halfman1775 and the best email is halfman@freakscene.net

Hey great! Lucked into a copy of Siouxsie’s Hyaena ealier this year and found ol’ Robert on it. Never knew they actually played together. I assume he was pullng double duty at the time.
First heard the the Cure about 15 years ago, despite the poofter drama-mimes in my high-school. They kept the hairspray, I kept the respect for the music. Glad to hear Smith is still at it.
